DOGFIGHT DECIDER ON BREED BRAWL.

GOLD COAST SUN NEWS

6.5.2009. Brent Melville.

STAFFY RESULTS MAY HAVE CANINE CONSEQUENCES FOR COUNCILS.

A five year battle to get the Gold Coast City Council into the Supreme Court and a dog named

Tango out of 'exile' in NSW is finally expected to come to fruition in June or July.

Gold Coast woman Kylie Chivers is challenging the council's now abandoned identification

method that resulted in Tango being deemed a banned pit bull terrier.

A win for Ms. Chivers could open the way for dog owners who have had animals seized and

destroyed to sue councils for compensation.

Five years ago this month, Tango was put in an animal Motel near Tweed Heads to escape

council destruction orders.

Ms.Chivers will call on witnessess including the head of Genetics Laboratory in Melbourne

and a breed expert form the US, to prove Tango is a pure breed American Staffordshire

Terrier.

Jon Mokomoko, a paralegal assisting in the case, said the council would have to choose one

of the dates in June or July and could delay the case no lomger.

"We have filed a notice of intention to proceed on the available dates and the council has a

month to prepare their case,"he said.

Ms Chivers will be seeking compensation including $30,000 in kennel fees to keep the dog

in Tweed Heads, as well as travelling costs.

"I they the council concede and seek to settle out of court, they have to settle on our terms,"

said Mr. Mokomoko.

He said Ms Chivers was also planning to take civil action against the council.

The Gold Coast City Council refused to comment on the case or confirm it was going ahead.

the council are in a corner now...

Yes, they sure are. And, scientifically speaking, always were.

I admire tremendously all the people who've hung in there for Tango. :)
