Roguedog Posted March 2, 2013 Share Posted March 2, 2013 Have you reported the incident to the AVA?? they have the power to take disciplinary action if a veterinarian has failed their duty of care when treating your dog, im also sure they would know of solicitors that handle dog related cases.... Tralee Posted March 3, 2013 Share Posted March 3, 2013 I think your best position is that: There is an expectation that dogs in off leash areas will behave like dogs. Therefore there is an obligation on each dog owner to provide for the welfare of the dog. Irrespective of the off leash expectations dogs are still protected by the provisions that it is not an offense if the dogs is; provoked teased or protecting property. Property includes protecting your person. My case was a bit dfferent. My dogs were simply at large and unfortunately encountered a woman with psychiatric issues. Being the cynic that I am :) I would be sceptical about professionals investigating their own. Though by all means lodge a complaint with the AVA so there is a record of the incident. I am sure someone will come along and tell me the absolute answer, but I thought the AVA & The Veterinarian Boards were different entities. The AVA being a bit like the PIAA where members can freely choose whether they are part of a private organisation where as the Veterinarian Practitioners Board is an independent government body ? The AVA doesnt/cant deal with complaints as far as I know it must go through the Vet Practitioners Board ?? Danois Posted March 3, 2013 Share Posted March 3, 2013 If it is an issue with quality of care with a vet then it is simply tort law/ negligence in the provision of professional services and most lawyers can deal with it. They don't need to be an animal law specialist. But NSW does have an Animal Law Committee as part of the Young Lawyers Society. Look on their web page or contact them for a list of names.
