This is the million dollar question, you see the GCCC only did what they did to stop one dog "Tango" from being allowed to return back to the Gold Coast, the fall out and the fact that like the email from Animal Control to Cr Dawn, they have admitted that the only Pit bulls now in Australia are Amstaffs. "If they come back OK we can exempt the dogs if necessary and return them as long as no AmStaff is in the DNA line." They also know that around 100% of all the Pit bulls I and Logan Timms have test results for, come back at not being Amstaffs, so the Pit bulls are free to do as they want, next time the Gold Coast City Council spend over $500,000.00 on legal fees out of spite, they may think twice. This is only the start, we are testing other dogs forced out of the state, they will also come back not Amstaffs. The question, what are they doing to the Amstaffs, nothing... this all was to try and get one up on Kylie Chivers for showing the world how stupid the GCCC are, funny they did a better job than we could.

Message from Cr Crichlow John I asked the question about the DNA testing - have received the following answer- FYI - We are happy to do it but require their permission if you can suggest they give it to us we will have it done straight away. We have no evidence that the dogs they used for the test were theirs. The test results were dated in June but the dogs were in the pound since May? If they come back OK we can exempt the dogs if necessary and return them as long as no AmStaff is in the DNA line. Kind regards Dawn

We encourage our customers to understand that our Breed Signatures are based on the purest pedigree dogs, and thus a true BITSA (dogs with mixed breed parents and grandparents) may not exhibit the exact features of the breeds detected. It is also important to realise that primary breeds are the result of at least one pure bred dog being present at the parental level in your dog’s ancestry. Many canine traits are diluted with other characteristics. For example a primary German Shepherd and a secondary Golden Retriever may look very much like a German Shepherd, though with slight differences, such as a slightly longer coat, different shaped ears and a marginally warmer coloured coat. Why doesn’t my dog have a breed for every generation? It is important to understand that BITSA can only detect breeds that are present in a dog’s ancestry. Sometimes in a dog’s ancestry either one or both parents can be termed ‘outbred’ (dogs with mixed breed parents and grandparents). In this case a distinct breed signature is not present within a dog’s DNA. As the dog is heavily mixed, this may prevent a primary or secondary breed from being determined. Next let’s start getting dogs that have been ordered out of the state back home, one comes to mind, a dog called "Bella" for Logan City Council. Her crime, she was light tan, with a bully head, four legs and a tail and experts from Logan City Council using the 22 point checklist, now proven to be false in the Supreme court, said she was a Pit bull terrier. (Chivers Vs GCCC, the validity of the 22 point checklist went unchallenged). Expert, Debora Pomeroy, the person who trains and created the 22 point checklist must be feeling very sick at this time as she has killed 100's of dogs using her system training many other Animal Control Officers to do the same making a tidy packet at the same time, also owning a pure bred Amstaff...sorry I mean Pit bull terrier. We will let you know how we go.

Just to show you, that not only do we know that the DNA test works here in Australia, but even in the USA their are other affected dog owners who have problems with councils trying to falsely identify their pets as Pit bulls. Bad luck the whole world uses the internet. Open this and play from half way through, 3:25, Logan Timms, I think you will get the point. Have fun watching I think David Letterman should run for mayor for the GCCC or at least Head of Animal Control as he is as smart as they are.

Answers: 1 The dogs are at the GCCC pound, 9 days before the results. 2 The dog owners. 3 You follow the instruction from the test kit, it's not hard to put a cotton bud in your dogs mouth ( maybe for some) 4 Read instruction with test kit, if too hard read web page. 5 Air dry cotton bud, put in plastic envelope provided, seal, as instructed, put in envelope provided, mail. (The GCCC have been watching too much CSI I think.) Rather than accuse Rangi of being a liar and committing fraud or attempting to deceive them in some way, for shit's sake, they have the dogs, do the test themselves, why the need for all the Buls@#t? One thinks they are stalling or trying to look professional or something.

This is the reply from the Gold Coast City Council, regarding the newspaper and the Ch 9 news yesterday: Remember this is why we have a problem with this councils ability to identify a suspected dog as anything. Apart from the Bits Breed identification certificate dated 23 June 2010 and "Breed History Revealed" document, there is no evidence management documentation to confirm how the DNA sample were taken from the subject dog and how those samples reconcile with the DNA results. To assist me in the following conducting an internal review of this desion, it is necessary for you to supply Council with the following information within seven days: Provide details of: 1 Where and when the samples were obtained. 2 Who took the samples. 3 Is the person who took the samples, approximately qualified to otherwise trained to take DNA samples. 4 Details of the sample methodology. 5 Chain of custody documentation for each sample. Should you require information assistance regarding this matter, please contact Animal Management Inspector Norton 5581 6664.
  10. Just saw the interview with Rangi on the Gold Coast News on Channel 9. The Gold Coast City Council claim that the DNA may not have come from her two dogs. What a joke, if that is the only explanation the Gold Coast City Council Animal Management can come up with, that’s nothing but pathetic, it's not rocket science GCCC. Since you have had the dogs in the pound for months why not DNA them yourself? Oh hang on, that's too sensible and easy. Would you like me to come and do it for you? I'll even pay for the test. Kylie Chivers Step 1: I will give you a kit with the cotton buds to take samples or ask Cr Dawn, CEO Dale Dickson or even ACO Geoff Irwin as I have already given them kits in the past. Step 2: Put cotton buds in one end of dog, the wet end, not the brown end. Step 3: Wiggle it around, for a few seconds, get a good sample. Step 4: Air dry it, put it in the envelope provided. Step 5: Fill out form, send cheque, post. Results will be in 5 days. I know it all sounds hard but look Step 2: it's not the end with the tail, does that help any?

The American Staffordshire Terrier has a breed signature found through DNA. The APBT is nothing more than a mixture of breeds as the BITSA test will prove this!Better start saving GCCC".

Here is a copy of an email today with a reply, slowly affected dog owners will challenged their local council action: Thanks Jon, It's very interesting isn't it!! literally i could come straight back to the coast with my dogs and say well you can't prove they're amstaffs so tough shit!! I do feel for all the amstaff owners who all along thought that they were getting a 'legal' pitbull, because without a doubt that's what many people assume, and again there are many people who think they are one and the same, and it will always be an argument.. purists believe there is no such thing as a Blue pitbull, same as no amstaffs have rednoses, but there are genetic throw backs in the states where registered amstaffs have red noses... and so on. Pure bred Amstaffs in this country have at least had some professional input from some great breeders, whereas many good pitbull lines have probably deteriorated due to the bans and being forced underground, if only they had the balls to put proper controls on dog ownership and breeders we wouldn't be in this situation. So the question is where now? The GCCC will probably change the goal posts, and make the law on looks alone and get rid of genetic profiling in their quest to cull all dogs that could possibly look dangerous. I have emailed Logan Timms, mentioned ethical breeding and tighter controls but he did say that councils can add whatever breed they want on their banned list, regardless of import and federal laws, I think one of the QLD councils (Harvey bay) may have changed their view on it and only declares dogs dangerous on their behavior. thanks again Dear G In the past all councils in South East Qld used Phenotype, (the 22 point checklist) (a phenotype is any observable characteristic or trait of an organism) to identify suspected Pit bull terriers, and in 17A BSL laws they also had the term TYPE which can mean anything, now removed from the Animal Management (Cats and Dog) Act 2008. After the Chivers Vs GCCC they openly admitted without contesting the fact the 22 point checklist was false, the use of Animal Control officers as expert did not come to the standards as experts under the rules of law, so the only scientific way to determine breed is a DNA test, the problem here is, the Gold Coast City Council, were being to smart by, adding Amstaff as Pit bulls, is like a double edged sword, "something that has or can have both favorable and unfavorable consequences". This will stand up in court, as the GCCC was the one who paved the way for this to happen. They opened this door, we are more than happy to use it. Email Geoff Irwin and state, "I have done a DNA BITSA test on my dog, it has not come back as an Amstaff so it is scientific proof that my dog in not a Pit bull terrier but simple a cross bred look-alike dog, so can you give me a lawful reason why I can not return him to the Gold Coast City Councils jurisdiction”. Include this section in your complaint; they might even try to give you an honest attempt at relying to your complaint….(..no won’t happen..) “Thank you for your letter …….to the Honourable Desley Boyle MP, Minister for Local Government and Aboriginal and Torrest Strait Islander Partnership, regarding the recent Supreme Court decision on American Staffordshire Terriers. The Minister has asked that I respond on her behalf. It was never the State Government’s original intention to include American Staffordshire Terriers in the definition of a “Restricted dog”.   16. The reason for the info: I have a meeting with the minister for local government Wednesday 2.00 pm regarding his new Bill before the house regarding local government, including 17A. I have overturned 39 dog breed identifications showing clear proof that local councils in Qld have been paying so called self trained experts to mislead and manipulate the courts by providing false documentation and fictional verbal evidence. Over the past few months the news papers at least here in Qld have finally seen the light regarding CLAIMS of transparency and accountability by the state Government are a sham. most of the laws are "for show". "There was no serious intent to make these things work, A government does not have to be accountable as long as they can convince the voters they are honest This could explain why and how this BSL law got passes and why it is so hard to get any government department to validate or give any reason why it should be in place. BSL protects the community from dog attacks? How can banning/restriction four breeds of dogs, when three of these breeds are not present in Australia, in any real number and the pit bull terrier represents 1.8% of the total dog attacks in Australia, that’s the same as Poodles, and just below Labradors, and from my research I can not find one death from a Pit bull terrier published in Australia. This government should be held directly responsible for the deaths of the people (Children) since this law was brought in. But more to the point is the total disregard to the legal system and the courts in general, so much for local council being a model litigant, the way they treat the court system as if it was a child’s play toy, or a joke. March 17th, 2007 an American bulldog-Catahoula mix — attacked and killed Pamela Rushing. Pamela Rushing, 50, was found mauled to death in her backyard in the Forest of Friendswood subdivision. She died of multiple dog bites, according to a medical examiner’s report. Wieners said police believe Rushing was killed when she tried to intervene in a dogfight, although it is unclear which dog turned on her first, the chief said. At least one of the bites found on her body matched the teeth pattern of the retriever, reports show. Rushing died from multiple dog bites — primarily those of the bulldog, the chief said. Rushing had been dead for about four hours when police arrived. Coroner ( Edwin Batt ) found Harlie’s owner ( Debra Susan Marks) Contributed to the death by keeping a vicious & aggressive dog in such a way that it could & would attack. Mrs Marks partner David Bruce purchased the dog Harley from the council pound in Transinski. 1998 Rottweilers and a Rottweiler-cross In a similar case in Western Australia, Giovanni Pacino, 35, was convicted of manslaughter in 1998 and sentenced to three years' jail - since overturned - after his Rottweilers and a Rottweiler-cross mauled 85-year-old Perina Chokolich to death in her garden. 1998 Nov 9 Cattle Dog and Great Dane cross Bull Terrier Grandmother at Charters Towers mauled to death after trying to stop dogfight. The two dogs involved were a Cattle Dog and Great Dane cross Bull Terrier. They were her pet dogs. 1997 April 16. Bull Mastiff X Great Dane, X Bull Terrier Meadow Heights 12 Years old Boy ( Jarrad Dwyer ) was mauled to death by a Bull Mastiff X Great Dane, X Bull Terrier in the back yard. Kimba was the family pet. Autopsy showed dog had a fractured skull from a blow with a ball hammer. Which was not reported in the (media). 1997 - Victoria - Unknown crossbred? 1995 December 27 Toowoomba Labrador cross with some Bull Breed Elderly Woman (B Stringer) visited friend’s house and was mauled to death by a Labrador cross with some Bull Breed in its ancestry. This dog was reported in the media initially as a Pit Bull Cross then changed to American Pit Bull Terrier. This is despite all relevant people clearly stating the above crossbreed. 1995-96 -South Australia Akita bit a drunken owner through an artery and he bled to death. 1995 June 7- Perth 3 Rottweilers & a Rottweiler cross GSD Elderly land lady ( Perina Chokolich age 85 ) killed and mauled beyond recognition in her vegetable garden. Dogs involved were 3 Rottweilers & a Rottweiler cross GSD Owned by Giovanni Pacino age 35.
