Thats what i have explained to her over and over over again. she classes them not being able to get the airport a fault on their behalf and they have changed their minds and that they are legally responsible for covering all additional travel expenses because the original agreement was that she took the pup to the airport. but because she couldnt get there on the day has arranged for dogtainers to pick the pup up from her house, and has agreed to pay half of the additional cost. so my mum said to them you either pay the whole amount of $100 or I will take you to court. and then said to them, you either refund my money then in full or i will take you to court because under the companion animals act 1998 it states that apparently she hasnt received the pup yet so she has to give all of her money back, and that if she already had the pup then she would have to refund 50% then if she changed her mind?? i read that act over and over again and it states nothing of the sort about deposits etc.. now the breeder doesnt want her to have the pup ( i understand why completly) and has offered to give 50% back after she resells the pup to someone else. -

her original quote was $245 and then its was an extra $100 because the breeder couldnt make it to the airport and the pup had to picked up from the house instead and the breeder has offered to pay $50 of the additional cost for the muck around. I am being sympathetic of the breeder, her father has a bacterial infection which is eating away his stomach and has to go into surgery on the day the pup has to be flown out, which is why she cant take the pup to the airport herself, hence the extra amount from dogtainers. and because of this as i stated, she has offered $50 contribution to the extra costs, I have offered my mum money....she still thinks that its the breeders fault and that they have changed their mind blah blah and changed things on their end hence they should be held liable for any extra expense? i hate feeling this way about my own mother this breeder is going through hell with her fathers illness and my mum is hassling them over a measly amount of money.... -

her headstrong attitude is starting to embarass me a little ay... she got me to ring the breeder and I talked to them, they are such nice people and they are truly concerned at the meer thought of their puppies going to anyone who is so indecisive...... while i was trying to talk to them...my mother was in the background trying to talk legalities....i wanted to hide under a rock i ended up telling them, that its between them and her and I have only being trying to keep things calm and cool in this situation because i consider it a straight open and shut case, and that i think she should take option 3 because it suits everyones interests. they thanked me for trying to sort it out and I told them i will try to talk her out of the lawyer and lawsuit idea. fingers crossed again, thankyou for all the opinions they have helped alot -

Oh well...im her daughter and she is my mum lol i have told her everything i have read here and even got her to read it over herself and she thinks she is still in the right..... as i said...so you are going to disregard a plethora of knowledge because you assume the customer is always right.... the pup is not a piece of clothing.... -

the breeder is refusing to sell her the pup now and has told her on friday after she gets their vet work done she is going to readvertise her for sale and then after the pup has found a home will be refunding the total price of $225 ( 50% of what my mum has paid so far) my mum said she is seeking legal action....i just shook my head......i reminded her that a lawyer is going to cost more anyway....and that if she couldnt afford $50 extra on the transport then why go to a lawyer its going to cost more then for a consultaion, thats even if a lawyer will not laugh her out of the room first, seen as the breeder has given every option available. sad at the moment...... -
What has PETA got do do with this? Dogs and cats are companion animals, that is a fact. Horses, cows, sheep (just to name a few) are livestock. That is also a fact. What I was thinking.

99% is a hell of a statistic dont you think?? my cousin alex was attacked by a mastiff x ridgeback when he was 5 years old, the dog knew him well, alex was always respectful of the dog, and the owner one of our family friends was a very lovely owner. alex was playing with him in the loungeroom on the floor as he would usually do and digger attacked him unprovoked , no warning, nothing. we all there and it looked like he was going to lick him and all of a sudden he had taken a piece out of alex's arm and even though with his owner and my aunty trying to pull him off tried to continue to attack him. I think genetics can have a lot to do with the matter aswell. and I have been bitten by a very horrid little dacshund a few years ago, I was walking talia and this little dog came flying out from under the fence and bit me on the leg! i reported it and the council contacted the owner about the issue. the person who owned the dog was at work at the time and had not idea her dog would do such a thing because she has kids a etc and he has always been fine with them. its not always the owners fault, the parents or the minders, it is possible for some dogs to attack unprovoked, they are naturally hunters after all its only natural, the best people can do is try to watch the signs.

woolworths seems to be ok. not sure if that cheap but it seems pretty inclusive im pretty sure you dont have to pay any extra and you can even get vaccinations and stuff done.

my brother wont go near a horse since he saw what happened to drew on neighbours all those years ago i keep trying to tell him that was very dramatised, even though things like that may happen, its not a reason to live your life in fear. Im not scared of horses, even though my parents put my horse to sleep after that incident when I was 7 I have still never hesitated to give one a good riding , i love riding through the bush and doing some hurdles here and there But I agree about the livestock and companion animal thing. dogs are bought to be peoples friends and companions and when they cross that line and become a danger its in the best interest of the dog and human to have the dog pts. ( not saying this is the case all the time because some cases are not so open and shut) but as it has been mentioned you dont just walk into your friends home and have a horse start biting and hanging off your face or throat or trying to rip your arms off ( just an eg please dont take this literally lol)

I think it was bondi vet( or some other vet show) that had a doberman or something that had been given ecstasy or some other drug like that. this was a few years ago, but my goodness that doggy was a sick and disorientated fella, was lucky to live -
when i was 7 my horse ran me straight into a tree and then threw me into a fence that hard barb wire on top. i needed 27 stitches and i had a broken leg. my parents got the horse PTS.

yes, the breeder asked her what the exact reason was, " health, moving etc.." and because it was simply change of mind over an tiny extra added expense of like $50 or something, she breeder said that is definetly not a valid excuse to go back on what they discussed and i agree. Im a bit dissapointed at my mum atm but its her choice after all .... -

lol talia my husky used to like a good wrestle haha before her arthritis got really bad :p which is why I like big doggies, I think lil doggies are cute but I feel like they are going to break hahahahaa omg im going to have a baby next year i better get used to the "little" feeling -

my thoughts exactly. i hope she makes the right decision by the puppy herself and the breeder. she didnt sign a contract but the breeder did tell her beforehand that deposits were not refundable without reasonable cause etc.. so yes she knew what she was doing. the breeder told her something along the lines of not being a savings account lol i thought that was a lil funny, i would have never thought of putting it that way to someone. that she is not savings account where she banks peoples money until they want to use it for other purposes lol and yes i love cavs if i wasnt a big doggy person i would get one :D thanks for all of your help DOL :) much appreciated -

my mother is the one who consulted me about it I went round for dinner last night and she came out with it and started asking me what she can do etc etc I have already expressed my opinion on what i would do in this situation, and yes it is up to her in the end. i just dont like seeing my mum upset -

I found out the breed she is getting is a- cavalier king charles spaniel this part i was relieved about The breeder has given her 3 options- continue the contract and take extra time to pay pup off wait for a pup from another litter and the money she has put down will be honoured towards said pup after she resells the pup to a new home she will reinburse 50% of the price she has paid which would be $225 50% because of the stuff around and costs incurred I told her to take the third option. but my mother is insisting on the "full refund" i tried to explain to her that she has been given 3 options and that i think the 3rd option would be fair on all parties. considering the breeder has had to tell a few other people that the puppy has been sold interstate etc. and has lost a few customers because of this, this was the only blenheim puppy in the litter. and also tried to tell her, that after reading alot of info on dogzonline that it costs alot of money to breed and rear healthy genetic tested puppies and the parents and that her getting her $225 back is a fair choice. she has been paying the puppy since it was 2weeks old and the eyes had opened. I thought impulse..because thats how my mother got her cats ( pet store) and got her rabbits ( pet store) i guess she has put some thought into it. I agree with the breeder on one of the emails they stated that they have put the pup aside in good faith for her and steered other buyers clear because it was marked sold, that they have already paid for the vet checks for the puppy and that mother also had to have an emergency casesaran which cost the breeder $1250 etc... and that it is not fair that they lose everything and that she gets away scott free just by changing her mind. i just wish my mum would accept the third offer...I dont want her to bring a pup home that she doesnt want either..... -

I agree i want my mum to happy but im also angry at her for buying on impulse.....she wont even tell me what breeder or what breed this pup is.....im hoping to god its not a designer dog
