  10. Royce is Free. http://www.blacktownsun.com.au/news/local/...om/1801248.aspx High price for freedom BY RODERICK SHAW 13 Apr, 2010 09:09 AM ROYCE the dog has come home to his Blacktown owner, Jock Coulter, seven weeks after his removal by Blacktown pound. ``I'm ecstatic; I just felt elation when told I could take him home,'' Mr Coulter said. ``He's my best friend; the only one happy to see me every day.'' Royce, a 13-year-old mastiff-cross, was seized by Blacktown pound officers who said he was a pit bull and therefore a dangerous dog. However, Mr Coulter said Royce was not a pit bull, nor had he ever attacked anyone or another animal. Blacktown councillor and veterinarian, Russ Dickens, said he had treated the dog for years and had never heard any complaints about him. Mr Coulter also said he was told he had to build a backyard enclosure for Royce, which he said cost him a great deal of money. But last week he had his dog professionally assessed for its breed. ``She [the assessor] said Royce was half mastiff and half ridgeback,'' he said. He said the pound then allowed him to take Royce home and wished them well. Mr Coulter said he was happy to have his dog home, but unhappy about what had happened to him. ``Look at the costs I've incurred building that cage in my backyard,'' he said. ``I still don't know what Royce is supposed to have done. ``It's ground me down; I can't say what it's done to me.'' Mr Coulter said he was worried the same thing could happen to another dog owner. Cr Dickens has asked Blacktown Council officers for an explanation of the affair. The Sun contacted Blacktown Council for comment, but it could not reply in time for publication. In the meantime, Mr Coulter is dismantling the cage once meant for Royce. ``I'll keep a bit of it for a garden shed,'' he said. tybrax
  11. I have been contacted by a law firm to find the owners of dogs who have been destroyed because they were accused of being American Pit bull terriers. They need the following information: 1. Was the tool called the 22 point checklist used as the method of identification? 2. Was the tool, (22 point checklist) used by a Queensland Animal Control Officer? 3.Which Council? 4.The name of the Animal Control Officer. 5.Do you have a copy of the Tool (22 point checklist) supporting documentation from the respective Council? If not, don’t worry as they can be obtained very simply. 6.All copies of correspondence between yourself and the respective council’s preexisting relationship. 7.If your dog was removed out of the state, or destroyed. 8.What dog breed/cross had you asserted it to be? 9.Your contact address/email and phone number. Please contact Tyra, at [email protected] or [email protected] tybrax
  12. You should no your the one telling the story? l wont be commenting on your posts anymore, your facts are wrong!! Yes, the council/ratepayers have to wear the bill - but remember, it was the owner's that took council to court, not the other way around. Irrelevant, the Judge ordered the Council to pay why should innocent tax payers pay for a fraudulent law.??...........mmmmmmmmm!! tybrax
  13. Yep thats it, Sheer Malice!! tybrax Oh FFS! It was a Supreme Court case with huge ramifications which ever way it went and most likely tens of thousands of dollars in cost. I don't think malice has anything to do with it. The council even offered the owners to return Tango to his home on the Gold Coast years ago as a restricted dog but the owners cut their noses off to spite their faces and refused. OFF'S ,The council stated if they could prove tango was and amstafff then he could be returned to the Gold Coast, they proved it years ago, council ignored it. So your facts are wrong!! Nose out of joint what a load of rubbish!! You sound like ACO J.T. The costs are huge and the council have to wear the bill, or should i say the poor tax payer. "During times of universal deceit, telling the truth becomes a revolutionary act." --George Orwell.
  14. Excuse me, but were you around when the DaFre case went to Magistrate's court in Qld? That is where the late Mrs Brashears first gave evidence in Australia, and where, like Ms Chivers, the dog owner sought to show that the checklist method of identification was rubbish, and the council and its "consultant identifiers" were promulgating rubbish! Were all the critics of Ms Chivers and her legal team and witnesses, criticise one it implies all, so full of foresight that they THEN said, do not use this attack as it will end up putting the AST in the crosshairs? Didn't think so--all the angst now is due to the magic of foresight and we all can be superlative at that when we choose! But it helps NOBODY! Good post. ZBC

  17. American pit bull owners vow to fight on Thomas Chamberlin | April 7th, 2010 Related Links $500,000 to keep dog off death row AFTER spending almost $500,000 on their fight, a couple plan to appeal against a Supreme Court decision that ruled their dog was an American pit bull, preventing it from returning to its Parkwood home. The court yesterday ruled American staffordshire terriers were the same breed as the outlawed pit bull. The decision has potentially dire consequences for Queensland's 25,000 AmStaff owners, including at least 1000 on the Gold Coast. Kylie Chivers and John Mokomoko took on the Gold Coast City Council in court over the identification of their dog Tango as a pit bull, rather than an AmStaff. It meant the dog was deemed dangerous and needed to be put down but they moved the animal to a safe location in a kennel south of Tweed Heads more than five years ago. In NSW, Tango could be registered as an AmStaff. Yesterday, Justice Glenn Martin dismissed Ms Chivers's application, stating that Tango was an American pit bull -- the same breed as an American staffordshire terrier. This followed expert evidence, supplied by Ms Chivers, that the council ultimately relied upon. "The conclusion that I draw from that evidence is that the name American staffordshire terrier is a name which was adopted in the United States of America for purposes of promotion or other similar reasons and that that name was applied to American pit bull terriers," said Justice Martin. "That practice appears to have been adopted in Australia. "Therefore, as I am satisfied that the applicant has demonstrated that Tango is an AmStaff, it follows that Tango is also an APBT and is thus subject to the restrictions under the local laws referred above." Related Coverage $500,000 to keep dog off death row Outside court, Mr Mokomoko said the decision would set a precedent and he predicted Queensland councils would now enforce AmStaffs as pit bulls, declaring them dangerous. "They will have to register as a restricted dog (if born before 2005) and have them desexed," he said. "If born after 2005, it has to be destroyed. We are going to appeal with the help of the Australian national kennel club and the American pit bull club." The Gold Coast City Council yesterday called on the State Government to clarify whether the ruling effectively outlawed AmStaffs. Local Government Minister Desley Boyle said the council's local laws were responsible for prohibiting dogs, but the Government would examine the ruling to see if it had any implications for state animal management legislation. In a surprise twist, Mr Mokomoko yesterday said he was contacted by the council which was considering making changes to local laws which could allow the dogs to live on the Gold Coast under strict guidelines. Justice Martin did not order Ms Chivers to pay costs.
