What are my rights

So my day has just got even worse both our pups went in today to be desexed, have retained baby teeth removed and Lotti to have X-rays, Lotti has been diagnosed with Megaesophagus and Eli we have found out has Lingually displaced mandibular canine teeth, we have been told he needs to see a dental specialist and also that it’s a hereditary condition and we have been advised to contact his breeder and expect at least a partial refund of his purchase price but preferably a full refund.

Can anyone tell me if this is something I should expect from his breeder, the condition could end up costing us thousands.

Shit Rascal. What is your relationship with this breeder like? If it has been good then when you are feeling a little calmer just send them a message advising what your vet has told you. Don't put any expectations in the email - make it just an information email and if this breeder is at all concerned about the quality of their breeding stock, this pup  and you as a new owner of one of their pups then they will make you an offer and you can start some negotiations. I am not a breeder but if it was me the first thing I would be asking for is a report from a specialist and offering to cover the cost of this. A good breeder would want to know about something like this and be concerned and responsive.

You’re not having much luck. My daughter’s cocker spaniel pup also has this. I didn’t realise it was hereditary though. 
 

From what I’ve just read, you should definitely let the breeder know so she can assess her breeding program.

Definitely let the breeder know. If it were me, I would request at least a second opinion before proceeding.

 

From there things may get difficult and options will need to be discussed.  

One thing that I would like to put out there, and which may not be popular, but is actually standard under the law is that if your expectation is a full refund, then it is within the rights of the breeder to expect to have the puppy returned to them.

Thank you for that information it is what I suspected. We can’t give him up so would be happy with a partial refund so at least that money can be put towards his medical bills. I would also be happy to take him to whatever vet the breeder uses to get a second opinion if necessary.

I have the handout the vet has given, I’m happy to take a pic and post it if you want to read it, apparently it’s a recessive mutation and both parents have to carry the recessive genes.

Sorry if this isn't a nice question,  but are these pedigree pups from a registered breeder?  If so and the breeder isn't willing to provide support (and guarantee the breeding won't be repeated), seems like there's a need for name and shame.  The pedigree dog world is in decline.   Breeders who fail to provide support for pups with serious congenital defects do the system no good.

Yes she’s a registered breeder and advertises on here, we are still waiting on his papers (limited register) as far as I know Eli’s mum has been retired from breeding as she was also looking for a pet home.

How many pups were in the litter? 

If there were more pups perhaps some of the other pups are similarly affected and the breeder is already aware of the problems.

I’m not sure how many pups in the litter, when we met Eli we only saw him and his brother.

I have been in contact with the breeder and she feels now his retained baby teeth are gone the adult teeth should position themselves correctly, I guess we just see what happens and go from there.

Lotti is a byb mix, she was bred by one of my customers, they got stuck with 3 out of 8-9 pups so I offered to take Lotti in exchange for some free grooming (they have 5 adults) I haven’t informed them yet but I will after Xmas (too much to explain why) not sure how it’ll go down because their dogs are very neglected and I don’t think they’ll give a damn

if you look at the State Govt web sites, there are very specific things about what and how much the breeder is liable for.  I think it is 100% refund up to three years old if the defect can be traced back to the breeder.  I will try to find the details for you and send you the link or you can PM me if you would rather do that.
