A judge of Victoria's County Court ruled that the stud Murray Grey cattle - including two bulls and three calves - were shot by an RSPCA inspector with "indecent haste". Judge John Bowman on Friday said that the herd was put down without consultation of its owners, James Holdsworth and Heather Ellison. The pair sued the RSPCA for damages - reported at more than $2 million - after its inspector Jason Nicholls shot the cattle in the presence of colleague Mark Roberts following a complaint about starving animals. Mr Holdsworth and Ms Ellison argued the cattle were not in a condition that required destruction while the RSPCA denied negligence. It argued the cattle were abandoned, neglected and in an emaciated condition. In his summarised key findings, Judge Bowman said when Mr Nicholls rang Mr Holdsworth on May 27, 2003, Mr Holdsworth told him he was part owner of the cattle. He arranged to meet Mr Nicholls on May 30 and that Mr Holdsworth was "not aware of the urgency of the situation or that the killing of the cattle had commenced". The judge said that Mr Nicholls did not contact Mr Holdsworth on May 28 when he had "put down a few animals and made arrangements for a major assessment of the herd the following day". On May 30, he said, Mr Nicholls, who at all times was "in control of the situation and the operation", started the "assessment process which was effectively a culling of the herd". Judge Bowman continued: "If any doubt existed as to the ownership of the cattle, this had been removed before the assessment process began ... Nicholls having been provided with the results of the business name search." At an earlier stage, before the killings, a contractor working for the Framlingham Aboriginal Trust - which owned the property where the cattle were agisted - spoke to Mr Nicholls about Mr Holdsworth coming for a meeting on May 30. Judge Bowman also found that Mr Nicholls at not stage clarified the "ownershi p situation" with a veterinarian Dr Callum Irvine who attended the property and met with Mr Nicholls. "Had Dr Irvine known that the ownership of the animals was something of which Nicholls was aware and an owner would have been a available on Friday, 30 May, to discuss the matter," the judge said, "that would have absolutely made a difference to the course of the action". Judge Bowman said that "in controlling the situation, Nicholls effectively did not permit the treatment of individual animals." He continued: "The whole operation conducted by Nicholls on behalf of the (RSPCA) ... seems to have been conducted with what could be described as indecent haste. "There is effectively no reason why that whole operation could not have been put on hold for at least a day so that Holdsworth (and Ellison) could have been consulted in relation to what could be done with the cattle." The case was adjourned for the question of damages to be argued.

No big mystery on changing birth dates - that website requires puppies to be 8 weeks old before they are advertised so if a breeder wants to sell them and take deposits earlier they say the pup is older - as the pup really does get older they change the date of birth. And registered doesnt necessarily mean registered with the state controlling body and you can get a breeder with a registered prefix who is registered with a different registry. Some breeders dont have a registered prefix but use their registered business name too.
  4. I have owned and bred Saints and always fed them on only raw food. Ian Billinghurst actually worked with a Saint Breeder way back when he was first writing his book. I bought his book and used it as my bible - followed everything he said and advised and this is what I advise you to do. There are lots of opinions and not all of them are good and feeding raw chicken wings or frames gives you just the right calcium and in the right ratio for all you need re calcium and phosphorous ratios.
  5. When you place an ad on that site you have to say if you are a registered breeder - that is registered with any one - the council, a state body under the ANKC the MDBA , the aapdb and a dozens of others. Registered doesn't just mean ANKC registered.

I asked about actually changing the standard to either be more specific about colours or else to say any colour or combintaion of colours except brindle and black/blue and tan, but apparently that isn't possible either. I was thinking about the whippet standard. It says any colour so in theory you could have black and tan whippets. I'm not sure what would happen if someone tried to register one though. People can register anything they want as long as they call it what it is supposed to be called. Years ago White boxers were not able to be registered so they were registered as red and white and not taken out . I thought Dogs NSW was now responsible for the registrations for Victoria - makes no sense that they are different. If the boxer people want to register their dogs incorrectly that's up to them, but the Iggy breeders responsible for this petition want to register their dogs accurately for future generations. If you would like to add your support it would be appreciated. Yeah I get it

  8. Looks to me that the variation in rego requirements needs to be taken to the ANKC rather than Vicdogs - but it is only about a drop down list is that right?
  9. You cant have one state making up its own rules - its all under one banner - the ANKC - you may find some differences in requirements for the codes and policies re membership etc but never the registry.
  10. Me too from what I can gather they are only asking for a drop down box during the rego process - not for them to accept other or different colours - is that right?
  11. It is correct, as I understand it, the VCA is disregarding it, so breeders want to petition them to abide by the decision made back in 2010 by the ANKC Really? ANKC decisions are binding on all CC's. Adherence isn't optional. I'd be bringing to the attention of the ANKC Breed Standards Committee. Given that the ANKC pedigree register is now administrated by Dogs NSW, I can't see what Dogs Vic do or don't do affecting the colours of pups as they are registered. Non standard colours might make the Limit register but they can't be upgraded. I agree and also petitions will never make any difference to things like this - if the CCs were open to everyone who wanted one thing or another getting their way via petitions or by demands the whole system is shot.

  14. This is such a horrible thing as it really is a death sentence - you may be able to buy time but much depends on how late it is and either way its not long. Do you mind me asking - is it a registered purebred dog?
  15. BWM has been nominated many times for the MDBA Pet Insurance Company of the Year. These nominations come from their clients and are checked and are genuine. Having said that Petplan has done well in previous years too. My frustration comes through trying to contact them to tell them they have been nominated. Most are hard to contact and some you cant get to speak to anyone at all . It is for this reason Id go with BWM because at least you get to speak to someone who cares about the brand of their company.
  16. A breeder shouldn't just turn up and drop a pup off with anything including a heart murmur - should have been informed prior to this so they could make an informed decision
  17. Not exactly by his side Steve Yeah - we have one thats all over my hubby like this - sometimes I wonder if he is wearing it never me though because they know I dont like it.
  18. Ive got kids and people coming and going all the time and they bark to let me know Ive got a visitor but as long as they know them or their car etc its not bailing them up. Mine know that normally if I like you I will let you onto my front porch once you are on the porch with me their isnt a sound. Its about what they are used to - your sister's dog clearly wasnt used to people coming and going but if its normal from day one the dog sees it as normal.

  20. Maremma make great pets in the right home. The fact they have lots of people coming and going isn't an issue but they need to be aware that the dog will need to be part of the family so their job is guarding the family as it would a flock of sheep - being alone for long hours isnt an issue either .it will work out very quickly what is and isnt normal and fit in and adjust without a problem. Biggest issue is the dog will bark at anything it sees as not normal and in suburbia this can be an issue - car doors slamming, passers by etc - because thats how they work. I have placed many in pet homes including with autistic kids and the elderly but thats where the dog is by the owners side all day every day .

Dont do anything at all until you have done a business plan - as you work through that one by one it helps to know what you will do, how you will do it and how you will market it etc - It takes a while - doesnt have to be perfect but I promise you that it will mean the difference between success or not.
  23. Sorry not sure what you mean - bitches with these conditions can be bred and sadly are bred but these conditions are not ordinarily caused by over breeding. My comments regarding assumptions were in consideration of the assumptions made by the OP.
